General Terms and Conditions

1. Validity of the GTC and conclusion of the contract

1.1 These General Terms and Conditions (GTC) apply to sales contracts with private customers and companies concluded via the provider’s website.

1.2 The order is confirmed by the supplier. The contract is concluded as soon as the confirmation arrives at the buyer. These GTC also apply to distance purchases that are made in other ways, e.g. by telephone, fax or letter. They will be delivered to the customer in writing with the order confirmation. If a customer does not agree with the GENERAL Terms and Conditions in such cases, he can use his right of withdrawal, see clause 5.3.

2. Prices and special offers

2.1 Prices are quoted in CHF. This includes VAT and an early recycling fee. Handling fees and shipping costs will be charged separately.

For corporate customers:
The price covers all services necessary for the proper performance of the contract. The agreed price in particular compensates for packaging, transport, insurance costs, expenses, royalties and all public charges including VAT. For foreign suppliers, the price covers all delivery obligations in accordance with Incoterms 1953, as amended in 2000.

2.2 Cartello GmbH reserves the right to change the prices at any time. The prices published on the website on the order date apply to the customers.

If Cartello GmbH subsequently increases the prices, however, the lower price applies on the order date, also if the contract has not yet been confirmed.

2.3 The conditions for promotions and discounts are available from the information in question.

3. Terms of Delivery

3.1 Delivery is normally made within 2-3 working days. If a longer delivery period is necessary, the customer will be informed at the latest after this period has elapsed. If no information is provided, the customer is entitled to waive the delivery in writing.

3.2 In the case of mailing A-Post+ (without packaging, simply cheap) the product is taken out of the box, the box is combined and the product is shipped with a folded box and any package leaflet. This allows the parcel to be sent as a letter. By selecting this shipping method, the customer waives any notification of defects in the packaging and any transport damage to the product.

3.3 The performance of the contract is at the time of handover to the shipping partner. Shipping for orders in the online shop is at the risk of the customer. The customer undertakes to immediately check the delivered goods for correctness, completeness and integrity. Damage to the delivered goods must be reported as soon as possible, but no later than 5 calendar days after delivery, to the executing transport company and to Cartello GmbH.

3.4 If a product is confirmed on the order confirmation “in arrears”, the subsequent delivery of the said product may take between one and ten weeks. If the period of subsequent delivery takes too long for the customer, he has the right to an equivalent replacement product or a refund of the paid amount.

4. Right of withdrawal and right of withdrawal

4.1 Right ofcall
Customers can withdraw from the purchase agreement within 14 days without giving reasons and without penalty. The period for exercising this right begins on the day on which the goods arrive at the consumer. The customer can return goods that have already been delivered at the expense of the supplier (at his own expense).

The right of withdrawal can only be exercised legally if the goods are returned unused, undamaged, complete and in unopened original packaging. All products returned in this way are controlled by us. Purchased products must not contain any traces of use. A withdrawal is rejected if:

  • traces of use are visible
  • The product is damaged due to transport

If the product is lost during the return transport, no costs will be refunded. We recommend sending the product with a vendor that offers Track & Trace. Upon receipt of the goods returned in the described condition, the customer will be refunded the value of the goods.

4.2 If a customer withdraws from the purchase due to defects in the goods or other reasons for which Cartello GmbH is responsible, Cartello GmbH will refund amounts already paid as well as the return costs.

4.3 In the event of an effective revocation, the services received by both parties shall be returned. Only the sale price of the returned product will be refunded; Any customs duties, taxes and the original shipping costs will not be refunded. A handling fee of 25.00 CHF will also be charged. The refund of the selling price is made by the same way as the original payment reached us. For products ordered by advance payment, we need the appropriate bank details for the refund.
You must comply with payment refund obligations within 30 days of sending your cancellation notice.

5. Liability and Warranty

5.1 Cartello GmbH does not guarantee that the goods have the guaranteed properties, for which the manufacturer of the products assumes the guarantee.

5.2 The buyer must inspect the delivered goods as soon as possible and report defects immediately. Customer service can be contacted at info@cartello.ch. Secret defects can still be objected to after commissioning or use of the goods. The performance of payments shall not be deemed to be a waiver of notice of defects.

5.3 If there is a defect, the buyer has the choice to withdraw from the contract or obtain replacement delivery. The buyer’s right to claim damages is reserved in all cases.

6. Payment

6.1 Payment is possible at the request of the customers in the following ways:

  • Bank payment
  • Paypal
  • Twint
  • Credit Cards
  • cash on delivery, with additional fees, which are shown in the payment options.
  • The customer can provide the number of his credit card. All major credit cards are accepted. The price of the goods is recorded on the day on which the goods are sent.

6.2 In the event of late payment, Cartello GmbH will send a maximum of two reminders. A fee of CHF 25 will be charged for the second reminder. If the customer does not pay, enforcement measures are initiated. In addition, default interest of 5 percent will be charged in case of late payment. Claims for damages are reserved.

7. Liability for online connections

7.1 Cartello GmbH undertakes to ensure security according to the current state of technology and to comply with the rules of data protection in systems, programs, etc. that belong to them and over which it has influence.

7.2 Customers must ensure the security of the systems, programs and data that are within their sphere of influence. Customers should keep passwords and usernames secret from third parties in their own interest.

7.3 Cartello GmbH is not liable for defects and faults for which it is not responsible, in particular not for safety defects and operational failures of third-party companies with which they cooperate or on which they are dependent.

7.4 Furthermore, Cartello GmbH shall not be liable for force majeure, improper action and disregard of the risks on the part of the customer or third parties, excessive use, unsuitable equipment of the customer or third parties, extreme environmental influences, interventions of the customer or interference by third parties (viruses, worms, etc.) that happen despite the necessary current security precautions.

8. Application of the law and place of jurisdiction

8.1 Swiss law applies to these General Terms and Conditions, in particular the regulations of the OR.

8.2 The court shall have jurisdiction to hear actions brought by a customer at the domicile or registered office of one of the parties. The court at the defendant’s domicile shall have jurisdiction to hear actions brought by the supplier.

For business customers:
The place of jurisdiction is the registered office of the supplier (or the registered office of the customer company).

For foreign consumers:
For foreign customers, the courts at the customer’s domicile or at the registered office of the provider are responsible at their discretion.
